The 112th Congress has an unprecedented plan. They are going to read the Constitution-the document that each member will swear to uphold-aloud on their first day. When asked on MSNBC to comment, Washington Post writer Ezra Klein replied “It’s a gimmick. I mean, you can say two things about it. One, is that it has no binding power on anything. And two, the issue of the Constitution is not that people don’t read the text and think they’re following. The issue of the Constitution is that the text is confusing because it was written more than 100 years ago and what people believe it says differs from person to person and differs depending on what they want to get done.”

NOAA's Catch Shares Fisheries Debacle

Barrack Obama came to office with an agenda to fundamentally change America.  An element of his agenda is a plan, known as catch shares, to restructure the nation's fishing industry.  The author of his plan is Dr. Jane Lubchenco, the environmentalist rock star and former vice chairperson of the Environmental Defense Fund (EDF).  When it comes to the oceans, the protection of fish, and the punishment of the evil fishermen, Dr. Lubchenco is as extreme as Obama's former green jobs czar, Van Jones.

Obama, with no managerial experience himself, didn't simply make Dr. Lubchenco one of his numerous czars -- he anointed her as the head of NOAA despite her own complementary lack of managerial experience.  Effectively, Obama has given the EDF control of the $4-billion, 13,000-person government agency that oversees the national fisheries.

Obama Returns to End-of-Life Plan That Caused Stir

WASHINGTON — When a proposal to encourage end-of-life planning touched off a political storm over “death panels,” Democrats dropped it from legislation to overhaul the health care system. But the Obama administration will achieve the same goal by regulation, starting Jan. 1.

Under the new policy, outlined in a Medicare regulation, the government will pay doctors who advise patients on options for end-of-life care, which may include advance directives to forgo aggressive life-sustaining treatment.

Congressional supporters of the new policy, though pleased, have kept quiet. They fear provoking another furor like the one in 2009 when Republicans seized on the idea of end-of-life counseling to argue that the Democrats’ bill would allow the government to cut off care for the critically ill.

Stymied in Congress, the Obama administration is moving unilaterally to clamp down on power plant and oil refinery greenhouse emissions, announcing plans for developing new standards over the next year.

In a statement posted on the agency's website late Thursday, Environmental Protection Agency administrator Lisa Jackson said the aim was to better cope with pollution contributing to climate change.

"We are following through on our commitment to proceed in a measured and careful way to reduce GHG pollution that threatens the health and welfare of Americans," Jackson said in a statement. She said emissions from power plants and oil refineries constitute about 40 percent of the greenhouse gas pollution in this country.

Why is it any dumber than a law called the Patient Protection and Affordable Care Act, which promises to cover more for less money?

When Obamacare was debated, we free-market advocates insisted that no matter what the President promised, he and Congress couldn’t repeal the laws of economics. Our opponents in effect answered, “Yes, they can.”

Well, Obamacare has barely started taking effect, and the evidence is already rolling in. I hate to say we told them so, but . . . we told them so. The laws of economics have struck back.

Health insurers Wellpoint, Cigna, Aetna, Humana, and CoventryOne will stop writing policies for all children. Why? Because Obamacare requires that they insure already sick children for the same price as well children.

COURT DECISION SENDS WARNING TO PREDATORY LAWYERS
State appeals court rules that so-call environmental groups must pick up the tab for "frivolous" lawsuits

(Orlando, FL - December 17, 2010) After years of clogging up the courts with frivolous lawsuits and then sticking taxpayers with the bill, anti-free market interest groups finally got a taste of their own medicine.

Earlier this week, Florida's First District Court of Appeals ordered 1000 Friends of Florida and the Martin County Conservation Alliance to repay Florida taxpayers for attorneys fees incurred during the course of a land-use appeals case.  (Read the court's opinion here)

Environmental groups quickly predicted that the ruling would have a "chilling" effect on future litigation.

"Good," said Ryan Houck, executive director of Citizens for Lower Taxes and a Stronger Economy.  "Taxpayers have been footing the bill for this type of frivolous, dead-end litigation for years while special interest groups abuse the legal system with impunity.  Too often, these lawsuits are simply a tool of the anti-free market agenda, designed to obstruct job-creation at taxpayer expense.  Policymakers should follow the court's lead and take action to deter this type of costly, frivolous litigation in the future." 

Litigation stemmed from the 2007 passage of Martin County's Land Protection Incentives Amendment.  The amendment to the county's comprehensive plan permitted property owners to cluster houses in exchange for preserving the rest of the land.  The amendment did not increase the number of houses permitted on the property and an Administrative Law Judge ruled that the amendment would not create sprawl or more development.

Senate moves on nuclear arms treaty

The Senate plunged into debate on a new U.S.-Russia arms control treaty Wednesday after Democrats secured the backing of a significant number of Republicans in a crucial test vote of President Barack Obama’s top foreign policy priority.


The White House and senior Democrats have expressed confidence that they had the two-thirds majority needed for ratification in the Senate. In a fresh sign of momentum, Democrats easily prevailed, 66-32, to move forward on the pact, winning the support of nine Republicans. Among the GOP senators was Sen. John McCain of Arizona, Obama’s 2008 presidential rival and a top lawmaker on national security issues.

"The U.S. and Mexican governments have launched a range of initiatives that challenge the traditional view of 'hold the line' and are developing a framework for a new vision of 21st century border management."

Today is Bill of Rights Day, a national civil holiday established by President Franklin Delano Roosevelt through proclamation on Dec. 15, 1941. Considering his track record, FDR was certainly not someone you’d expect to honor to such a document and the principles it embodies, but it was after all the 150th anniversary of the ratification of the first 10 amendments to the U.S. Constitution and perhaps he was expected to go at least through the motions of paying his respects.

Only weeks after Florida voters tossed Amendment 4 into the dustbin of bad ideas, Jane Healy has managed to misread the most obvious of signals. In her column "Will Scott and Cannon play games with growth?" (Orlando Sentinel, Nov. 28), she calls for new growth controls in the midst of a devastating recession while neighboring states aggressively compete for Florida jobs. Only Healy could imagine that the 67-percent-to-33-percent defeat of Amendment 4 means that Floridians have an appetite for new regulation.

Sustainable nightmare to plague Napa County

It’s been over three years since Napa County Supervisor Bill Dodd told me Agenda 21 was the plan for Napa County. Agenda 21 is the blueprint for implementing the United Nations (U.N.) Sustainable Development goals for “Economy, Equity and Environment.” These U.N. goals are in the Napa County General Plan. The U.N. continues to sell Agenda 21 as a sustainable utopian dream for Earth’s future, but Agenda 21 will be a sustainable nightmare for Napa County.

When I researched U.N. Agenda 21’s website and read related documents and articles in 2006, it was obvious the laws and regulations to meet Agenda 21’s international requirements were going to gradually smother our freedoms. Thinking I was doing the right thing, I hand-delivered Michael Shaw’s “Understanding Sustainable Development (Agenda 2l): A Guide for Public Officials” to Supervisor Dodd’s office in October 2006. Shaw was a member of the Agenda 21 bureaucracy in Santa Cruz, and described the scope of sustainable development in his guide. I was warning Dodd because we were already conversing about stopping Measure I. Dodd wasn’t in his office when I arrived, but Shaw’s guide was left on Dodd’s desk with a note from me. The next morning when Dodd called, I was shocked when he told me Agenda 21 was already the plan for Napa County. Until Dodd told me, I had no idea Agenda 21 existed in Napa County. Since then, I’ve done more research and learned from citizens exposing Agenda 21 in other communities.

For all his talk of job creation, President Obama has targeted many occupations for extinction. Using un elected bureaucrats to implement a host of job-killing measures, his administration is generating piles of pink slips:

Oil: Even before the BP spill, Obama's Interior Department had cracked down on domestic drilling. In 2009, regulators allowed less than $1 billion in new oil and natural gas leases on federally controlled areas -- both onshore and offshore -- compared to $10 billion under President George W. Bush the year before.

Then, in response to the Gulf spill in April, Obama slowed down things even further, with a moratorium on deep-water drilling in the Gulf of Mexico. That proved so unpopular that the administration officially ended it -- but it remains in force unofficially, as regulators bottle up drilling permits with red tape and delays, keeping workers idle. Most recently, Obama regulators placed the entire Atlantic and Pacific coasts off limits to drilling.

Factories: Rising regulatory burdens, energy prices and health-care costs -- Obama has left no stone unturned in making American manufacturing globally less competitive and in forcing jobs overseas.

The Democratic Party's message to politically involved citizens is unmistakably dire.  For those who attempt to expose voter fraud, expect to be harassed and even sued.  This is what happened to a group called the King Street Patriots (KSP) in Harris County (Houston), Texas. 

So far, intimidation has failed to deter these proud and steadfast citizens.  "These lawsuits are exactly the kind of abusive disrespect for citizens that got our political leaders into trouble. We will not be intimidated by partisan attacks, by the Democratic Party, or by anyone," is the defiant retort from volunteer leader of King Street Patriots, Catherine Engelbrecht.

KSP received national attention earlier this year when their initiative, True the Vote, discovered "numerous incomplete, inaccurate or false voter registrations."  KSP volunteers pored over voter rolls "double-checking all registrations" and even photographed vacant lots and non-existent addresses given on voter registration forms to validate their findings.

If 2009 was the year of birth of the Tea Party movement, 2010 was the year of ascendancy of constitutional conservatism. In many ways, the movements are the same -- except, perhaps, that the Tea Party is a movement of political activism by people who weren't traditionally activists, and constitutional conservatism represents an awakening about the way back to American exceptionalism.

For conservatives to emphasize constitutionalism is nothing new. The greater emphasis, however, is a bit of branding that helps distinguish them from establishment Republicans who stole the brand "conservative," or those whose policies are constitutionally limited only some of the time.

You know constitutional conservatism is on the right track when the liberal literati (Lincoln Caplan) and dimwiterati (Randi Rhodes) criticize it.

ZERO Carbon Emissions Produces Abject Poverty, Sabotages Hope

The industrialized world needs to realize that the radical environmentalists’ demand for a ZERO carbon economy by 2050 is a cruel hoax being perpetrated upon the poor. Succumbing to the unproven theory that burning fossil fuels is warming the climate robs the poor of the hope to improve their lives. Instead of feeling guilty for enjoying their energy-produced modern lifestyles, developed nations should encourage the undeveloped world with the knowledge to produce their own energy.

On Wednesday, I left Cancun’s paradise, where tourists enjoy running water and electricity, to visit a small village called La Libertad that has none of those amenities. It was like visiting an alternate universe, an extreme contrast to what is being taken for granted by delegates to the U.N. Framework Convention on Climate Change, Conference of the Parties 16 in Mexico.

On a midweek afternoon in February 2009, a month into the Obama presidency, Republican Rep. Mike Pence arrived at Columbus in his east-central Indiana district for a town hall meeting, the sort of event that usually attracted a few dozen constituents. Surprised to see the hallway outside the room crowded with people, "their arms folded and brows furrowed," Pence shouted down the hall to an aide, asking him to get a janitor to open the room. The aide shouted back that the room was open - and overflowing. Congress had just passed the stimulus bill (Pence voted no), and Hoosiers were stimulated to anger. Soon the Tea Party would be simmering.

Fundamental transformation--where have Americans heard that phrase before? In 2008, candidate Obama promised to “fundamentally transform” America which has resulted in skyrocketing debt and sustained joblessness. We surely do not want that on a global scale!

Yet, that is exactly what U.N. Secretary General Ban Ki Moon called for on Tuesday in Cancun, Mexico, at the U.N. Framework Convention on Climate Change, Conference of the Parties 16: “We need to fundamentally transform the global economy -- based on low-carbon, clean energy resources.”

Don’t Be A Liability

Preparation is not just about you, it is about all the people you save by not becoming part of the problem. The more Americans prep, the less Americans starve in the midst of calamity. Fewer empty stomachs means less fearful minds and less panic when the other shoe drops. In this sense, survival preparation is not a hobby, or a mode of self interest, it is a duty. Frankly, if we care at all about the continuity of our ideals, our belief in freedom and independence, then we should also feel obligated to become more self-sufficient. If the economy were to slip into oblivion tomorrow, would you be a pillar of strength, or just another frantic helpless man-child waiting desperately for a handout from the nearest criminal bureaucracy? Would you be a strong-point in the protection of liberty, or a weak link holding the rest of us back?

The strength of one can have reverberations in the lives of thousands. Preparation makes us strong. Adaptability and knowledge makes us unafraid. Training and experience makes us successful. These are the principles upon which America was founded, and these are the principles which will allow America to live on.

The recent sequence of reassurances from various eurozone policymakers suggests we are in the early, not latter, stages of the euro crisis. Only an Anglo-Saxon style QE will prevent dissolution of the euro. Such a radically un-German solution will only be taken with a full acceptance of how serious the euro’s problems are. But denial persists.

The dawning of reality hurts. Prodded and bullied along a tortuous emotional path by events unforeseen and beyond our control, we descend through three phases: the first is denial that there is a problem; the second is denial that there is a big problem; the third is denial that the problem was anything to do with us.

There is a blind spot in the main stream Conservative movement that threatens everything the movement says it stands for. The blind spot is refusal to acknowledge the threat of Sustainable Development, the policy of the UN’s Agenda 21 that now permeates into every American city. Somehow, the Conservative leaders who have always been there to fight off such utopian, socialist nightmares now seem to slumber blissfully in their ignorance at the very moment when vigilance is most urgently needed.

Sustainable Development is the greatest threat ever perpetrated against the American ideal of liberty. Sustainable Development is based entirely on the concept of wealth redistribution. Under Sustainable Development there can be no free enterprise, no individual liberty and no private property. If you doubt that, then here is a direct quote from the UN’s Habitat I 1976 conference where Sustainable Development was first being developed: “Land…cannot be treaded as an ordinary asset, controlled by individuals and subject to the pressures and inefficiencies of the market. Private land ownership is also a principle instrument of accumulation and concentration of wealth, therefore, contributes to social injustice.” That quote alone should bring the libertarians to battle-ready.
