A lawsuit for deprivation of civil rights under color of law and violations of Florida firearms and fishing laws was filed Wednesday against the City of Miami Beach and officers of its police department. The action was over an incident in which the officers assaulted, battered, and detained law-abiding fishermen at a Florida Carry fishing meetup on the South Pointe Fishing Pier on June 24, 2018, according to Florida Carry.

It got little attention on such a busy news day, but the Supreme Court issued a landmark rulinglast Wednesday for property rights.

The court unanimously ruled that the Eighth Amendment protection against excessive fines in cases of individuals charged or convicted of a crime applies not only to the federal government but also to the states’ seizure of property and other assets.

The particular case involved someone who was convicted for dealing drugs. Indiana authorities seized and auctioned off his Land Rover, even though it was not purchased with drug money, on grounds that he used it to commit crimes by driving it while dealing drugs (with that kind of tenuous connection, they could have seized his sneakers, too.)

Texas Can Get Trump's Border Wall Accomplished

Texas can make a border wall happen.  Many worry that courts will block President Donald Trump from building a border wall with funds reprogrammed from other projects under a declaration of an emergency.  However, Texas is in the more conservative Fifth Circuit, not the Ninth.

As an attorney who worked for Judicial Watch and more recently for Larry Klayman at Freedom Watch, this topic has prompted legal research by the author.

The border wall should be built exclusively in Texas at first, postponing California, Arizona, and New Mexico until after the Texas border is secure.  That will keep lawsuits in the Fifth Circuit and out of the Ninth.  Texas can make this happen.

1. Texas governor Greg Abbott should formally request that the president issue a declaration of an emergency.

2. Abbott should declare a state-level emergency.

3. Abbott should ask Texas officials to compile incidents of violence, gang activity, drug-smuggling, human-smuggling, sex-trafficking, etc. to document grounds for an emergency.

4. Abbott should make demand invoking Article 4, Section 4 of the U.S. Constitution that the federal government "shall" protect Texas against "invasion" by armed gangs and criminals.

5. The Texas Legislature should pass a resolution invoking Article 4, Section 4 of the U.S. Constitution that the federal government "shall" protect Texas against "domestic violence" spread from Mexico across the border, including armed gangs and criminals, drug-smuggling, human-smuggling, sex slavery, etc.

Decision-makers need to stop viewing this topic as one single step or as mutually exclusive with other actions.  Trump should declare a national emergency while still negotiating with Congress for appropriations.  It is not "either-or."  He can reprogram funds in a later, separate step.

Section 4, Article 4 of the U.S. Constitution commands the U.S. government – unconditionally – as follows (emphasis added):

"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive  (when the Legislature cannot be convened) against domestic Violence."

Congress passed the Secure Fence Act of 2006, mandating the following:

Not later than 18 months after the date of the enactment of this Act, the Secretary of Homeland Security shall take all actions the Secretary determines necessary and appropriate to achieve and maintain operational control over the entire international land and maritime borders of the United States, to include the following[:] ... (2) physical infrastructure enhancements to prevent unlawful entry by aliens[.]

The law further mandates that "operational control" means "the prevention of all unlawful entries into the United States, including entries by terrorists, other unlawful aliens, instruments of terrorism, narcotics, and other contraband."

Notice "entire" border.  Notice "prevention of all unlawful entries."  The act requires "all" of the border to be 100% secure, not just 700 miles, as people say.  The secretary of DHS has to decide what type of barrier is best in various sections.  But the result must – with no discretion – prevent "all" unauthorized entry.

However, Congress never appropriated sufficient money to fund the construction authorized by the Secure Fence Act.  It was yet another lie by politicians.  Yet under an emergency, any president can repurpose funds under the authority of 33 U.S. Code §2293.

President Trump's declaration of a national emergency would be unassailable in the courts if backed by a declaration of a state-level emergency; a request from Texas for a declaration of a national emergency; the legislative command of the Secure Fence Act of 2006; and a constitutional command of Article IV, Section 4.

Attorney General Greg Abbott – now governor – sent several letters to President Barack Obama calling for action.  One letter responded to bullets fired from Ciudad Juárez, Mexico that struck City Hall in El Paso, Texas on June 30, 2010.  See Texas Capitol Report, El Paso Times, June 30, 2010. 

Dear Mr. President,

Deadly violence from drug cartels and transnational gangs in Mexico is knocking on the United States' door with ever increasing frequency.  Yesterday, gunfire from the cartels pierced that threshold and struck City Hall in El Paso.  Fortunately no one was injured or killed.  But that good fortune was not the result of effective border control – it was mere luck that the bullets struck buildings rather than bodies.

Luck and good fortune are not effective border enforcement policies.  The shocking reality of cross border gunfire proves the cold reality: American lives are at risk.  As the attached news article notes: "More than 1,300 people have been murdered in Juárez this year as a war continues relentlessly between the Juárez and Sinaloa drug cartels."  Americans must be protected as this deadly war bulges at our border.

Law enforcement officials with the Texas Department of Public Safety and your own U.S. Customs and Border Protection will reveal the hard truth.  Our state is under constant assault from illegal activity threatening a porous border.

The time for talk has passed.  The time for action is now.  The need is urgent.  Each day that passes increases the likelihood that an American life will be lost because of the federal government's failure to secure the border.

This threat demands immediate and effective action by your Administration to secure our border.  As the Attorney General of Texas, I urge you to make border security your top priority so that no more innocent lives are lost to border violence.

A 48-year-old woman shopping in El Paso was struck in the leg by bullets that flew across the border from Ciudad Juárez while pushing a stroller on a busy downtown El Paso street (Fox News, February 22, 2012).

On October 8, 2015, The Daily Mail reported: "[A] gang of drug traffickers tried to hide from US border patrol agents next to [Olissa's] home. ... Olissa, of McAllen, Texas, lives two blocks from the border, and her home is less than a mile from the most dangerous Mexican border city, which has a higher murder rate than many war zones."

Abbott should immediately order a meticulous update of survey data of the whole border, even requesting LANDSAT satellite images.  Texas could upgrade roads and muster mobile housing for workers to move along the border as work progresses, water trucks, stockpiles of food, and cargo trucks.

Texas should immediately acquire 1,000-foot easements along the border by eminent domain where needed.  Under Kelo v. City of New London, Connecticut, 545 U.S. 469 (2005), lawsuits cannot stop eminent domain, only squabble after the fact over payments.  The correct approach is for only an easement, not the "designed to fail" approach of taking entire ranches whole to artificially drive up the cost.

If Trump starts in the Fifth Circuit, opponents can delay the project.  But they cannot stop it.  The sooner we start, the sooner we will get it finished.

We have heard that one of the upsides was that it put attention on the issue of rape in America. As if that horrible crime has been ignored in our society. It hasn’t. Others have said it focuses on victims, many who do not report the crime because they won’t be believed. There is no way unfortunately of having accurate data on crimes not reported. Politically, the left has made a cottage industry on using sensitive and explosive issues to hatch a political movement like MeToo, Black Lives Matter (remember hands up, don’t shoot?) and now taking a knee during the National Anthem in the NFL.

Environmental activist Maggy Hurchalla's appeal of a $4.3 million judgment by a Martin County jury on Feb. 14 has not gone well for her. At least, not until now.

Now Hurchalla, a former longtime county commissioner and one of Martin County's most prominent citizens, says she has evidence the jury foreman in the Lake Point Restoration tortious interference case against her was not a Martin County resident, as required by law -- grounds for a mistrial.

The Fourth District Court of Appeal has denied or dismissed most of Hurchalla's motions, including a previous request for a new trial, in case she lost in Martin County Circuit Court.

There it was again Thursday morning on National Public Radio -- the same old line we've heard repeated by CNN, CNBC, CBS, NBC, the BBC -- especially since Feb. 14: America has more deaths from mass shootings than anywhere else in the world.

Only, it doesn't.

True, America has a lot of handgun violence. But we don't have, as relentlessly suggested by news commentators, more mass shootings than anybody else and we're not the most gun-violent nation on the planet. Not even close.

Hungary's Unique Solution To The Soros Strategy

The main ruse of all Soros-funded NGOs is constant litigation. Today, most illegal immigrants enter countries in the EU legally but overstay or violate whatever visa they may have obtained.

When the illegals get detained waiting for a deportation trial, lawyers employed by NGOs funded by billionaire George Soros, have unlimited funds to plead for their release.

The litigation overcrowds detention centers, because the longer the deportation legal process takes, the fewer deportations can be carried out.

If the detention center overflows, the authorities have no other option but to let the low-risk migrants back into the population where they disappear. This is called catch-and-release, done to prevent the system from becoming overburdened.

The genius solution of the Viktor Orbán government to this particular problem, is that the border fence is not actually on the border. It is situated a few meters from it. So there is a strip of land which is legally Hungary, before the migrants hit the fence.

In some zones, the border fence cuts deep into Hungarian territory, creating large areas of Hungary outside of the fence. These are called “transit zones”.

When a migrant is caught inside Hungary, he is instantly transferred to the transit zone, through one of the gates. This act is not deportation, but detention as the migrant is still in Hungary.

Lawyers from these NGOs can do nothing to intervene since there are no legal remedies available to migrants inside Hungary, technically speaking.

The migrant is able is approach one of the barracks set up inside these zones where he could present an asylum request, wait for its processing and the subsequent court appeal if he is rejected.

The point is that while the migrant is waiting, he is outside of the fence, so he is not actually in Hungary, although legally he is.

The zone has no fence on the border side, so migrants are free to leave that way – back to where they came from. This measure obviously prevents overcrowding. Most migrants do not wait around for their trials, but go back to try to cross the border somewhere where it is easier to get into the EU.

But by not being present for a trial, the case is then dismissed.

So is does not matter how long it takes before a migrant is legally deported from Hungary, because he never entered Hungary and never burdened the state, since most of them leave the zone.

Spinning a Crossfire Hurricane: The Times on the FBI’s Trump Investigation

The paper buries more than one lede.

If you’re a fading Baby Boomer, you’re faintly amused that the FBI code-named its Trump-Russia investigation “Crossfire Hurricane.” It’s an homage to the Rolling Stones golden oldie “Jumpin’ Jack Flash” — which, come to think of it, might just be a perfect handle for John Brennan, the former Obama CIA director whose specter hovers over each critical juncture of the case.

The young’uns may not believe it, but back before it was known as “classic rock,” you couldn’t just play your crossfire hurricane on Spotify. You had to spin it. Fittingly, that is exactly what the New York Times has done in Wednesday’s blockbuster report on the origins of the Trump-Russia probe.

The quick take on the 4,100-word opus is that the Gray Lady “buried the lede.” Fair enough: You have to dig pretty deep to find that the FBI ran “at least one government informant” against the Trump campaign — and to note that the Times learned this because “current and former officials” leaked to reporters the same classified information about which, just days ago, the Justice Department shrieked “Extortion!” when Congress asked about it.

But that’s not even the most important of the buried ledes...

In normal times, the televisions are humming at the FBI’s 56 field offices nationwide, piping in the latest news as agents work their investigations. But these days, some agents say, the TVs are often off to avoid the crush of bad stories about the FBI itself. The bureau, which is used to making headlines for nabbing crooks, has been grabbing the spotlight for unwanted reasons: fired leaders, texts between lovers and, most of all, attacks by President Trump. “I don’t care what channel it’s on,” says Tom O’Connor, a veteran investigator in Washington who leads the FBI Agents Association. “All you hear is negative stuff about the FBI … It gets depressing.” 

Many view Trump’s attacks as self-serving: he has called the renowned agency an “embarrassment to our country” and its investigations of his business and political dealings a “witch hunt.” But as much as the bureau’s roughly 14,000 special agents might like to tune out the news, internal and external reports have found lapses throughout the agency, and longtime observers, looking past the partisan haze, see a troubling picture: something really is wrong at the FBI.
