Author of Federalist Society Report on Florida Justices: They ARE Activists

By: ERIC GIUNTA | Posted: October 31, 2012 SUNSHINE STATE NEWS

In an exclusive interview with Sunshine State News, Professor Elizabeth Price Foley of Florida International University College of Law condemns what she insists were "misleading" early media stories on a report she authored on three Florida Supreme Court justices up for retention on the November ballot.

The report – titled “A Review of the Florida Supreme Court: 2000-2012” and published on behalf of the Federalist Society for Law and Public Policy Studies, the nation's premier fellowship of conservative and libertarian lawyers and law students -- is being hailed by supporters of the justices as some sort of vindication of their record on the bench. Justices Barbara Pariente, R. Fred Lewis, and Peggy Quince are accused by their critics of being left-wing activists who do not rule in accordance with the principles of originalism, the doctrine that judges ought to interpret law according to its original public meaning.

Foley’s report is a review of nine rulings over the past 12 years which she says are among the justices’ “most controversial.” Foley does say that “there does not appear to be a pattern of unprincipled decision-making by any of the justices of the Florida Supreme Court.” However, she goes on to say that “[t]here are ... discernible voting patterns on the Florida Supreme Court and they seem to be based on the general ideological leanings of the justices.”

The hidden real truth about Benghazi

(ed.: Could this be why Romney did not engage Obama on this subject during the last debate?)

By Doug Hagmann  Sunday, October 28, 2012

Most people know that we’ve been lied to about the attacks in Benghazi, but few realize the extent of those lies or the hidden secrets they cover. After all, the lie is different at every level. Thanks to a well placed source with extensive knowledge about the attack, the disturbing truth is slowly beginning to emerge and is lining up with information contained in my previous articles published here weeks ago (Here, Here and Here). The truth reveals the most serious situation in the world today as it involves the interests and destinies of us all.

A mosaic of lies

According to the U.S. government, Ambassador Christopher Stevens and three other Americans were killed during a spontaneous protest at the consulate office in Benghazi by a frenzied crowd of Muslims outraged over an obscure internet video. Recently released “sensitive but not classified e-mails” from Stevens to the U.S. Department of State painted a picture of poor security for U.S. personnel and the embassy, which was obviously truebut had little to do with the events of September 11, 2012. The failure to dispatch an extraction team or otherwise rescue the men during a firefight that lasted upwards of nine grueling and tortuous hours was not the result of any intelligence failure, but caused by our unwillingness to widen the conflict and expose the nature and scale of our true mission in Benghazi.

Based on information provided by my source and corroborated elsewhere, the official account by administration officials is a mosaic of lies that were necessary to cover the unpalatable truth of covert actions taking place in Libya, Syria, Turkey, Jordan and Lebanon. The primary objective of our covert actions was to secretly arm anti-Assad “rebels” in Syria by funneling arms from Libya to Syria via Turkey, with other destinations that included Jordan and Lebanon.  Regarding the threat to Stevens and the other murdered Americans, the truth will reformat the persistent question posed to government officials, from UN Ambassador Susan Rice to White House Spokesman Jay Carney and others from “how could you not have known” to “how could you have done these things?”

First, it is important to understand that Ambassador Stevens, Sean Smith, Glen Dougherty and Tyrone Woods were not killed at a consulate office in Benghazi—as there is not such office there. They died at one of the largest CIA operations centers in the Middle East, which was located in Benghazi and served as the logistics headquarters for arms and weapons being shipped out of the post-Qaddafi Libya.

New IG report slams USDOL green jobs training program - How effective was taxpayer $$ spent?

WASHINGTON – The Department of Labor’s Office of the Inspector General cast new doubt on the effectiveness of the Administration’s Green Jobs Training Program. According to the newly released report requested by Oversight Committee Chairman Darrell Issa and Oversight Subcommittee Chairman Jim Jordan, the report revealed that the Department of Labor has further squandered taxpayer money since the program was flagged by the IG last year.

An October Surprise #tcot

An October Surprise

by Phyllis Schlafly | October 24, 2012

Eagle ForumPolitical pundits have been warning about an October Surprise that could affect the outcome of the presidential election. But this year’s October Surprise may have been the 9/11 murder of U.S. Ambassador Christopher Stevens plus three other Americans, and President Obama’s deceitful, cowardly response.

The fallout is the collapse of the false narrative that the assassination of Bin Laden brought finality to Muslim threats, the proof of the failure of President Obama’s Middle East policy, and the coverup. A coverup is a bad act or false statement followed by an effort to conceal or mislead public knowledge.

Obama got away with his war on Libya without congressional approval because no Americans were killed. Now four Americans have been killed.

The 9/11 attack in Benghazi, Libya was a preplanned, calculated, organized, military-style assault on U.S. territory and personnel. But the Obama Administration persisted for two weeks in spinning the fairy tale that it was just the spontaneous outburst of a mob angry about an anti-Muslim video.

On Sept. 16, the Obama Administration sent UN Ambassador Susan Rice onto five Sunday TV programs to redundantly present the party line that the torching of the consulate and murder of the U.S. Ambassador were merely an angry mob reaction to an anti-Islam video made in the U.S. Rice called the event “spontaneous, not a premeditated response” that seemed “to have been hijacked” by “extremists who came with heavier weapons.”

White House spokesman Jay Carney insisted on Sept. 14 that the attack was all about an anti-Muslim video, saying, “We have no information to suggest that it was a preplanned attack.” He spent eight days denying the obvious before he admitted that the label of terrorism was “self-evident.”

When Obama spoke to the United Nations on Sept. 25, he announced “the vision we will support.” Expressing “outrage” at the anti-Islam video (which he mentioned six times), but not at the terrorists or violent enemies of the United States, Obama proclaimed that “the future must not belong to those who slander the prophet of Islam.”

In an emotional pitch to the UN, Obama announced that it’s the world’s duty to condemn the video. Obama and Administration spokesmen almost sounded like they were empathizing with the rioters, and that it must be our fault for allowing a video to be shown that hurt the rioter’s feelings.

Mitt Romney challenged Obama on the Libyan attack in the second presidential debate on Oct. 16. Obama responded by claiming he had called it a “terror” event the day after it happened, after which moderator Candy Crowley showed her bias by immediately backing up his statement.

Fact checkers emphatically pointed out Obama had made a vague reference to unspecified “acts of terror” in his Sept. 12 Rose Garden remarks, but he absolutely did not apply the “T” word to the fatal Benghazi attack. It took Obama two weeks to admit that we had suffered another deliberate enemy attack, meanwhile whining that suggestions that he would “mislead is offensive.”

Obama spent more time discussing the evils of the video than castigating any particular violent attack from the Muslim world. He said Ambassador Stevens was “killed” in Benghazi without mentioning who murdered him, much less labeling them as terrorists.

Obama is deeply committed to the myth of a liberating “Arab Spring” and “the forces of change” to bring about democracy in the Middle East. He seems oblivious to the reality of how his policy of dislodging dictators friendly to the United States, such as in Egypt and Libya, has resulted in rule by Islamist forces who attack and kill Americans.

The evidence is overwhelming that Ambassador Stevens and his tiny security staff had made repeated requests to the Obama Administration for enhanced security and more security staff. Fox News reported 230 prior security incidents in Libya.

Assistant Secretary of State Charlene Lamb, who was in charge of diplomatic security, testified on Oct. 10 that she had placed “the correct number of assets in Benghazi at the time of 9/11 for what had been agreed upon.” That doesn’t square with the denials of repeated requests for enhanced security measures and staff.

Obama revealed his messianic self-importance in this interview given on New Hampshire Public Radio on Nov. 21, 2007: “The day I’m inaugurated, not only the country looks at itself differently, but the world looks at America differently…. If I’m reaching out to the Muslim world, they understand that I’ve lived in a Muslim country, and I may be a Christian, but I also understand their point of view.”

We hope congressional investigations will keep digging. We still want to know, what did Obama and other Administration officials know and when did they know it.

Connie Mack in Stuart with Mayor Rudy Giuliani

Connie Mack came to Memorial Park in Stuart this Sunday with Mayor Rudy Giuliani to speak to the voters of Martin County. Both men spoke of the need to take the Senate so that a real budget can be passed to reduce the deficit and balance the budget. Mack made a point of emphasizing his position that nothing else should advance in the Senate until a budget is passed.

The video clip above is part of a 15 minute address (recorded by Richard Nickson of our group). We selected this shorter snip because of Congressman Mack's comment on defunding the United Nations. The Congressman then posed in front of our signs against U.N. Agenda 21.

Rep. Connie Mack speaks about the U.N.

We thanked Congressman Mack for posing with the sign, and he pulled out a marker and bent over to sign the sign (right over the "NO"), as he said, "I'll do this any time!"

WE ARE JUST DUMB #tcot

NewsWithViews.com

“So what do you want? Dumb Growth?” this feller yelled at me from across the meeting room. He thought he was smart. (I thought that smart was probably only the first half of his handle.) I was supposed to be instantly shamed into silence. I wasn’t. “Why yes I do,” I replied. “If you mean by that- dumb is what we want to do with our lives and property and smart is what you want to make us do. Under that definition, dumb is what built this country. If dumb means the people’s freedom to choose, then dumb is better.”

He was a government trained facilitator. He was not supposed to lose control. But he did. He slammed his briefcase shut and stormed out of the room. By now folks had figured out what he was really up to anyway, so for him, that might have been smart.

We, on the other hand, are just dumb.   Read the article on NewsWithViews...

Like ObamaCare, Obama Core Is Another Power Grab #tcot

by Phyllis Schlafly October 10, 2012

logobannerWhen we list the areas that Barack Obama wants to “fundamentally transform” as he promised before his 2008 election, let’s not overlook his plans for education. They are as fundamentally transformational, costly and dictatorial as ObamaCare.

It’s well known that public schools are not graduating students as well-educated as before, that Americans score poorly on international tests, and that billions of federal dollars showered on public schools have not achieved any of the designated goals, which were to raise test scores and to eliminate the gap between higher income and lower income students. The Obama progressives want us to believe that the remedy is to turn over total control to the federal government.

That’s illogical and unacceptable, but it fits right in with Obama’s attitude that there is no higher power than the federal government. If Obama is reelected, he will be able to accomplish this task with help from Secretary of Education Arne Duncan, a graduate of Chicago politics.

Jesse Phillips: Judges, unions and the 'appearance of evil' #tcot

Published: Saturday, October 6, 2012

SOURCE

The Florida Supreme CourtThere is a scriptural adage that says that we should avoid “all appearance of evil.” Growing up, I took this to mean that in order to maintain our integrity and good standing, we should avoid any association or activity that could reasonably appear to be evil whether or not it actually was evil.

For the record, the title of this piece does not suggest that judges or unions are evil. My suggestion is simply that they may be entangled in a conflict of interest that has a very questionable appearance. Let me explain.

In 2011, Florida’s legislature passed a law requiring state employees to contribute three-percent of their salary into their pensions, saving taxpayers $1 billion per year. The unions sued to get this money back. On September 7th the Florida Supreme Court heard arguments. They are currently deliberating whether they should overturn the law and award that billion dollars back to the state employees.

Under normal circumstances this is a fiscally important case; but in this election year it’s nuclear.

The Justices are running for retention. Until recently their primary supporters were members of the legal community. For the past two years there has been no recognized support for the Justices outside of the legal community. We have learned, however, that they suddenly have a new ally, public sector unions.

Recently, the First Fraternal Order of Police and the Florida Professional Fire Fighters associations announced their support of Justices Pariente, Quince and Lewis. Although they’ve adopted anti-political rhetoric, their motive is transparent enough.

Why would the leadership of the police and fire unions take the unprecedented step of backing three Supreme Court Justices? Do they have anything to gain by joining their campaigns? I can’t think of anything they’d gain by backing these three Justices except their share of one billion dollars.

Think about it: Justices Pariente, Quince and Lewis are deciding whether to direct $1 billion to public employees and unions, some of which are directly supporting their campaigns! Is this evil? That's for you to decide. Does it have the “appearance of evil”? Yes.

I’m sure the Justices insist they will make their billion-dollar decision with absolute objectivity and that the unions’ vital role in their re-election will not cross their minds even once. I’m sure the unions will say that they are just looking out for the poor Justices whose $1 million campaign is being threatened by an evil youth pastor on Facebook.

Behind all of the rhetoric is a nagging question: is it ethical for a judge to make a ruling in a case when the primary financial beneficiary is also a known supporter of his re-election?

From the unions' perspective, is it ethical to suddenly join the campaign of a judge who is about to decide whether you will receive a share of a $1 billion payout?

I’ve been accused of compromising the Court’s independence. Ironic, isn’t it?

If the Court is to maintain its integrity and avoid the appearance of evil, Justices Pariente, Quince and Lewis should recuse themselves from this decision. That’s the only way they can avoid the charge of abusing their positions and gaining union support by the potential of a favorable ruling.

Do the right thing, Justices Pariente, Quince and Lewis. Recuse yourself. At the very least, issue a ruling on this case before the election.

PLANNING COMMISSIONS, SMART GROWTH AND LAND USE PART 1

Of all tyrannies, a tyranny sincerely exercised for the good of its victims may be the most oppressive. ... those who torment us for our own good will torment us without end for they do so with the approval of their own conscience. -C. S. Lewis

AuthorBack in the early 90's, I listened to Henry Lamb and Joan Veon on satellite radio telling us about United Nations Agenda 21 and what was coming to America. Now it's here, and it's in every city and county in America.

Some towns have citizenry who are aware and active enough to stall or destroy the efforts of local planners and Smart Growth. Other areas, despite large populations, have few who are willing to protect and fight for their property rights. In Knoxville, TN, few citizens go to city and county commission meetings and/or to local groups or meetings to fight Agenda 21 and Smart Growth.

Our county population is nearly 500,000, yet at the latest county commission meeting, there were less than a dozen knowledgeable people who attended this extremely important meeting. (We'll discuss this in part 2.) Our enemies are winning because of the apathy of our citizenry, and the work load is killing those of us who do all the fighting.

Let me tell you about the area where I've lived for the last 25 years. Midwest flatland doesn't exist in East Tennessee. It is a very hilly, beautiful area surrounded by the Smoky Mountains, lush with forests, lakes, rivers, and hiking trails.

How the NDAA Directly Threatens Average Americans, and How You Can Take Action Now

The NDAA turns the U.S. government into a dictatorship, the U.S. military into ‘secret police’Journalists rarely take a vocal stand against legislation in order to remain objective, but sometimes new laws are such an egregious assault on our basic rights to democracy and freedom that we have a duty to speak up.

This is the case with the National Defense Authorization Act, a relatively new law that gives the U.S. military the power to detain anyone without trial indefinitely, further criminalizing dissent and investigative journalism in the United States.

  • What does the NDAA do?

The NDAA gives the federal government the power to behave like dictators and arrest any American citizen, or anyone for that matter, without warrant and indefinitely detain them in offshore prisons without charge and keep them there until “the end of hostilities.”

The  American Civil Liberties Union, calls the law a “catastrophic blow to civil liberties”.

Obama lied to the public and said he would veto the NDAA’s indefinite detention clauses.  Instead, he surreptitiously signed the NDAA into law on Dec. 31, 2011 while most Americans were distracted celebrating New Years Eve.  Both Romney and Obama have publicly stated their support for the new law.

  • “I’m not doing anything wrong, I don’t need to worry about the NDAA”

You do need to worry.

Florida Voters’ Guide to Proposed Constitutional Amendments Released

October 4, 2012
FOR IMMEDIATE RELEASE
~ The Journal of The James Madison Institute analyzes 11 ballot amendments in a special edition; judicial merit retention amendment explored further ~

TALLAHASSEE, Fla. – As a service to Florida voters, The James Madison Institute (JMI) released a special edition of The Journal of The James Madison Institute that introduces and analyzes the 11 constitutional amendments on the 2012 ballot sent to voters by the Florida Legislature.

“We are pleased to have the opportunity to offer background and recommendations for Floridians to help better prepare them for what they’ll see on the ballot,” said Dr. J. Robert McClure, JMI president and CEO. “A similar evaluation was published in 2010, and since, we have received an outpouring of interest to release another. It’s easy for campaign noise to distract from the discussion on state constitutional amendments, thus we anticipate Floridians will use this comprehensive, user-friendly guide as a refresher or to get up to speed.”

For each amendment, The Journal Special Edition 2012 Voters’ Guide includes the specific language used on the ballot, a breakdown of each amendment and a pro/con analysis. Out of the 11 amendments, JMI policy staff provided recommendations on six including Amendments 1, 2, 3, 5, 8 and 10.

“As a result of the passage of the 2006 ballot amendment requiring that future proposed amendments receive at least 60 percent of the vote, it’s possible that this batch of amendments may face more of a struggle to pass,” said Robert Sanchez, JMI director of policy. “Several of these amendments are extremely important to Florida’s future, and we hope this service to Floridians will help reignite the conversation and encourage an informed vote.”

Additionally, The Journal Special Edition includes an article on the merit retention vote on three justices of the Florida Supreme Court written by Capitol Vanguard reporter Will Patrick. As outlined in the state Constitution, merit retention is a process whereby voters periodically evaluate the state’s appeals court judges, who are initially appointed by the Governor, during general elections.

“No Florida judge subjected to this process has ever failed to be retained,” said Patrick. “However, because of the increase in public awareness, this election cycle could be different.”

JMI: Reviving Our “Laboratories of Democracy”

By Robert F. Sanchez
June 2010

Let’s face it: There was a time in our nation’s history – and it wasn’t so long ago – when the phrase “states’ rights” was unfortunately synonymous with resistance to ending historic patterns of racial apartheid in the South.

Moreover, even before the civil rights movement gained traction, there was a long period in which many state governments were increasingly dysfunctional, with their legislatures dominated by blocs of rural lawmakers who clung to power and blocked fair redistricting.

So today’s advocates of returning power to its rightful place in the nation’s state capitals owe a debt of gratitude to an obscure Tennessean named Charles Baker. His persistence led to a landmark court decision that relatively few Americans know about.

It’s certainly not among those U.S. Supreme Court rulings so famous that no introduction is needed. Mention Roe v. Wade or Brown v. Board of Education, for instance, and most people immediately know the issues that were involved.

Mention  Baker v. Carr, however, and you’re apt to get a blank stare until you add that “it’s the one-man, one-vote decision” -- a term that in these more politically correct times has morphed into the politically correct “one-person, one-vote.”

Why Israel May Go It Alone #tcot

October 5, 2012
“There are two clocks ticking, one in Washington . . . and one in Israel . . . neither of them in sync.”

On the face of it, these words appear as if they were lifted from any report over the past year characterizing the discord over American and Israeli efforts to halt Iran’s nuclear program. But in fact they were spoken forty-five years ago by Israeli foreign minister Abba Eban on the eve of the Six Day War.

Eban had just returned to Jerusalem from Washington, where he was anxiously pressing the Lyndon Johnson administration to provide U.S. guarantees for Israel’s security in the event that Egypt attacked. Previously confident that America would have Israel’s back in the event of renewed warfare, Eban was now despondent at the likelihood that Israel would be forced to face the combined Arab armies alone, again.

The New American: McCain Anxious for NDAA Renewal for 2013

Written by   | Thursday, 27 September 2012

The New AmericanDuring the overnight Senate session that resulted in the passage of a “de facto declaration of war” on Iran and a stopgap bill that funded the federal government through March, Senate Majority Leader Harry Reid (D-Nev.) tried to push through a vote on next year’s National Defense Authorization Act (NDAA), as well.

An article published online by Government Executive magazine reports that at about 1:40 a.m. Saturday, September 22, Reid worked the floor trying to get support for the latest renewal of the controversial defense funding measure before his colleagues abandoned the Capitol for their home states.

"I've been asked on a number of occasions by Senator [Carl] Levin, Senator [John] McCain what we're going to do on ... the Defense Authorization bill. I ask unanimous consent that at a time to be determined by me, after consultation with the Republican leader, the Senate proceed to ... the Defense authorization bill," Reid said, according to the Government Executive story.

Foreign Policy blog The Cable reports that upon learning of Reid’s pre-dawn parliamentary plans, “Senate Minority Jon Kyl (R-AZ) objected ... because Reid wanted unanimous consent to structure the debate with limited amendments and because Kyl couldn't check with his caucus, as almost all senators had left the chamber.”

Join the ResistanceIn case you are one of those who doubt that our local government is promoting the United Nation’s Agenda 21 by way of unelected panels of people serving on “regional planning commissions” — groups who are pushing for the implementation of programs like “Plan NH”, “Sustainable Communities Initiatives”, and “Granite State Future”, programs that just seemed to pop up out of nowhere and have funding from the EPA/HUD/DOT, here’s proof.

New Video: Injustice on the Florida Supreme Court

It's October. We're coming down the home stretch. Today we are releasing a video advertisement highlighting an egregious decision in which Justices Pariente, Quince and Lewis threw out the conviction of a confessed murderer.

Watch our new ad
Please share this video. Almost 9 out of 10 people have never heard the names of these Justices, much less this injustice. Floridians deserve to know.
If you can chip in $10, $25 or $50 we will continue to spread the word. Your support is helping us reach hundreds of thousands of voters state wide.
PS - Thanks to your help, we were able to raise the money to print 100,000 of our score cards, many of which are being mailed out today.

Thank you for your ongoing support!
