States Should Flatly Reject ObamaCare Exchanges

Once Again They Refuse to Listen #NoStateXchng

ONCE AGAIN THEY REFUSE TO LISTEN

The Florida Legislature is preparing to implement a State Healthcare Exchange required by ObamaCare instead of standing on principle to reclaim their sovereign rights in this disgraceful power grab.

Just because the U.S. Supreme Court has decided that the "plan" is a constitutionally permitted "tax," it does not mean that it must be accepted in its present form (or at all). The question of its violation of the Congress' Constitutional authority has not yet been ruled, because the issue was not "ripe," and that challenge must come from the states. State governments must act to protect their citizens in the same manner as was done against the Alien and Sedition Acts of 1798. At that time, the legislatures of Virginia and Kentucky declared these acts null and void against their citizens and asserted their states' obligation to protect their own citizens (even against the federal government).  In the face of today's federal overreach, twenty-one states have already expressed opposition to these exchanges. 

The Florida Senate Select Committee on PACA (Patient Affordable Care Act) is having their first meeting on Monday, December 3rd at 3:00 pm. The members must know from today on that we expect them to say NO to any implementation of state exchanges for Obamacare.

In that effort, Florida opposition groups are hosting the tools you can use to let these people know that they are being watched very carefully. We are asking that each of you link to the following websites to initiate a letter of opposition to the legislators who are involved in this question and to our Governor, who is remaining undecided.

  • It is IMPERATIVE that every member of this committee be called and emailed between now and Monday afternoon.
  • They must be told to just say "NO" to implementing State-run PACA exchanges.
  • 21 other States will NOT be creating exchanges. FLORIDA must join those States in non-compliance.

Activist KrisAnne Hall, in recent confernce calls, referenced her articles on Nullification which are on her website along with a sample letter to be used for sending to our legislators and Governor. 

The Liberty GroupThe Liberty Group, a national patriot site, also posted an opposition page.

The Tenth Amendment Center has a petition and a resolution on their website.

Americans for Prosperity has an Action Alert on their website.

KrisAnne Hall recommended that we all send letters from our own perspectives - focusing on the constitutional and economic issues.  She is scheduled to speak before the committee on Monday but may only be given 2 minutes. They are trying to find out if other people can sign up to speak and then reserve their time for KrisAnne.

She suggested that we do an “e-rally” beginning at 3:00 p.m. on Sunday, December 2nd and run through 3:00 p.m. on Monday, December 3rd.  During this time we should bombard our Florida legislators and the Governor with emails, phone calls, faxes, and tweets. 

Anyone who can, should go to Tallahassee on Monday.  Please plan on visiting the committee members' offices prior to their hearing.  We need to make it clear that if they do go ahead and set up the health exchanges, there will be consequences to their actions. We need to let them know that we will not support them if they implement the exchanges. We also need to resolve ourselves to the fact that we will not comply with the law if it goes into effect.  She asked that we pass this information on to our members or anyone else we know who can help with this endeavor.

The federal government has been given $1 billion to establish exchanges and that money is ALREADY gone.  If we refuse to establish the exchanges, the federal government is not prepared and cannot establish the exchanges on their own.

This could be a fatal blow to the healthcare act as the federal government will have to ask Congress for more money to establish the exchanges and we can pressure them not to grant it.

(editor's note: Sen. Gaetz has already replied to this writer that, in his opinion, the Act was ruled "constitutional" and they are "obligated" to comply. WE DISAGREE.)

Remember, the more contacts you make, the more likely they are to realize that they are selling out their fellow citizens with this state exchange.

Tell your state representatives and senators:

  • The Federal government cannot force states to implement the exchanges (they currently have no ability to operate or to fund exchanges if the states don’t implement).  States will not have flexibility if they set up their own exchanges. Everything will have to be approved by the Federal government.
  • If the state sets up an exchange it is going to result in taxes on businesses ($3,000 per employee),  this happens only if a state sets up an exchange.
  • It will result in higher costs per family, either in premium costs or penalties.

We have already had an Exchange in Florida. Back in the 90's, called "Community Health Purchasing Alliances" (CHPA). They NEVER operated in the black - we, the taxpayers had to make up the difference every year. Sen Bill Nelson called them his biggest nightmare. Why would we want to go back to that (remember definition of insanity)?

Taxes are built into the bill that are linked directly to the premium costs, and will rise with a snowballing effect.  When the taxes rise, the premiums will rise.  As the premiums rise the taxes will rise. Nightmare.

68% of Florida residents would be eligible for the tax credits to help pay the premiums. Medicaid rolls would greatly expand. The federal government will send money for the first three years, after that Florida will have to fund a portion of it. Do you think Florida's share will be assessed favorably?

We will not finish this battle on Monday.  This will be an ongoing fight for many months. We will need your SUSTAINED support.  We intend to keep up with the contact after Monday, as a slow stream of constant reminders that WE WILL NOT COMPLY!

Rick Scott Keeps Options Open On Obamacare Exchanges

Florida’s Governor Rick Scott has been one loudest critics of President Obama’s ‘Obamacare’ healthcare law, and has vowed to do everything in his power to prevent the ominous job-killing law from being implemented in the state of Florida.

But while his pushback on Obamacare has garnered significant Republican and Independent voter support, Democrats have labeled him and others opposed to the law as “extremists” who are out of touch with mainstream America.

Now that President Obama has won re-election, Governor Scott has opened up dialogue with the Obama Administration on a possible compromise on the healthcare law, leaving conservative groups and activists extremely disappointed in Scott’s possible change in position on Obamacare.  Scott sent a letter to HHS Secretary Kathleen Sebelius asking her for a meeting to discuss what, if anything can be done collaboratively to reduce healthcare costs for Floridians.

Caught in a Budget Trap #tcot

The recent drumbeat from the political left on the disastrous effects of "austere" budget-cutting in European economies is intended to sandbag against similar policies in the United States. The key contention is that spending cuts have made budget balancing more difficult in European countries: supposedly, lower public spending in those countries reduced employment and income, reduced government revenues and increased the ratio of government debt to Gross Domestic Product. The left concludes that, to avoid a similar experience, the U.S. should increase spending in the short term, instead of cutting it, and attempt a "grand bargain" to balance long-term spending and taxes.

The problem is there may never be a "right" time to transition to the promised long-term structural budget resolution.

Stop Ratification of UN Treaty -- Possible This Week!

Senate Majority Leader Harry Reid announced that he plans to bring the UN Convention on the Rights of Persons with Disabilities (CRPD) to the Senate floor sometime this week.  The CRPD is another American sovereignty-threatening treaty, which President Obama signed on July 30, 2009, but has not yet been ratified by the Senate and for good reason!

We need you to tell your friends and neighbors about this new UN attempted power grab, and we need everyone to call and email your Senators, and urge them to vote against the CRPD treaty.

The American public cannot afford for this treaty to pass and allow the United Nations to implement more regulation that will have devastating effects on every American "person, organization, or private enterprise."  Worse yet, people with disabilities deserve better!  Addressing disabilities issues through an international bureaucracy undermines our ability to empower families and communities to serve disabled people’s needs.

The CRPD Treaty would expand the already growing powers of the UN in the United States, undermining our national sovereignty.  These new regulations are so complex that every American citizen will be impacted by the far-reaching consequences.

The CRPD Treaty will:

  • Exceed the bounds of the Americans with Disabilities Act and eliminate any remaining state sovereignty on the issue of disability law.
  • Demand that all American law on this subject conform to UN standards.
  • Force “every person, organization, or private enterprise” to eliminate discrimination on the basis of disability. This imposes impossible burdens and expenses onto private citizens, as they can be held in violation of the treaty if their private property is not fully accessible to persons with disabilities, even if they do not know any persons with disabilities.
  • Give the UN the power to determine the legitimacy and lawfulness of the United States’ budgets to assess compliance with such treaties.

Before the Senate left for recess in September, our conservative ally, Utah Senator Mike Lee, obtained signatures from more than 34 of his Senate colleagues asking that no treaties be brought to the Senate floor during the Lame Duck session.  The total has now risen to 36 Senators who have signed this letter. Below is the list of Senators who signed the letter.  If your Senator(s) signed the letter, please thank them and urge them to stand strong!
