OPINION: Birthright Citizenship -- A Fundamental Misunderstanding of the 14th Amendment

  

What’s the citizenship status of the children of illegal aliens? That question has spurred quite a debate over the 14th Amendment lately, with the news that several states, including Pennsylvania, Arizona, Oklahoma, Georgia and South Carolina, may launch efforts to deny automatic citizenship to such children.

Critics claim that anyone born in the United States is automatically a U.S. citizen, even if their parents are here illegally. But that ignores the text and legislative history of the 14th Amendment, which was ratified in 1868 to extend citizenship to freed slaves and their children.


The 14th Amendment doesn’t say that all persons born in the U.S. are citizens. It says that “[a]ll persons born or naturalized in the United States and subject to the jurisdiction thereof” are citizens. That second, critical, conditional phrase is conveniently ignored or misinterpreted by advocates of “birthright” citizenship.

The reauthorization of the Elementary and Secondary Education Act, the ESEA, (S. 1177) was passed by the U.S. Senate on July 16, 2015. This legislation, which impacts the education and the lives of our children, was placed on the Senate calendar on July 7th and passed in less than 10 days.

The ESEA is not set in stone yet. A House and Senate conference on the final version of the ESEA is the next step and that should begin in September. Decisions regarding the final version of the ESEA need to be postponed until the American people and our political leaders have more time to understand, scrutinize and debate the objectives, outcomes and amendments attached to the current version of the Elementary and Secondary Education Act.

The new version of the ESEA has been adamantly opposed and remains under fire due to some controversial and far reaching goals.

Barack Obama has always wanted to be a transformational president, and in this, at least, he has been true to his word. The question is what kind of America is being created, and what future does it offer the next generation.
President Obama’s great accomplishment, arguably, has been to spur the evolution of a society that formerly rested on individual and familial aspiration, and turn it into a more regulated and centralized regime focused on broader social and environmental concerns. This tendency has been made much stronger as the number of Americans, according to Gallup, who feel there is “plenty of opportunity ahead” has dropped precipitously – from 80 percent in 1997 to barely 52 percent today.
The shift away from the entrepreneurial model can also be seen in the constriction of loans to the small-business sector. Rates of business start-ups have fallen well below historical levels, and, for young people in particular, have hit the lowest levels in a quarter century. At the same time, the welfare state has expanded dramatically, to the point that nearly half of all Americans now get payments from the federal government.

WASHINGTON – The former director of the U.S. Defense Intelligence Agency claims the Obama administration made a “willful decision” to allow ISIS to form in an attempt to unite Sunni Muslims against the government of Syrian President Bashar al-Assad, according to a report from Joseph Farah’s G2 Bulletin.


Retired Army Lt. Gen. Michael J. Flynn said the assertion that the rise of ISIS caught the administration by surprise isn’t true.

The White House made a conscious decision, he said, when it sponsored the radical jihadists who later became the Jabhad al-Nusra and the Islamic State of Iraq and Syria, or ISIS, to fight the Assad regime.
